ABSTRACT: Koijärven suojelukiista vuosina 1979 ja 1980 lienee tunnetuin esimerkki kansalaistottelemattomuudesta Suomessa. Koijärvi-liikkeen kansalaistottelemattomuus sai ennakkoluonteen useassakin merkityksessä; kyseessä oli ensimmäinen laajempi kansalaistottelemattomuusliikehdintä Suomessa ja lisäksi kansanliikkeen toiminnan oikeutusta pohdittiin aina KKO:ta myöten.Muut ns. yhden asian ympäristöliikkeiden protestin kohteena ovat olleet m.m. puiston muuttaminen rakennusalueeksi (Turun Vartovuori), ydinjätteiden kalliosäiliöihin varastointi (Naiset ydinvoimaa vastaan-liike)ja Kessin metsäalueen hakkuun estäminen. Artikkeli käsittelee kansalaistottelemattomuuden eri määritelmiä (Smartin määritelmä, Erikssonin perustelutapa) ja eri tulkintavaihtoehtoja. The Koijärvi protection dispute (1979-80) probably is the most famous example of civil disobedience in Finland.The civil disobedience performed by the Koijärvi movement became a precedent in several respects: it was the first instance of broad civil disobedience in Finland and, moreover, the case was taken as far as the to the Supreme Court. Other examples of targets for single-matter environment movements are the changing of a park into a building site (Turku, Vartiovuori), the storage of nuclear waste in rock (Women Against Nuclear Power) and the prevention of the felling of Kessi forest area. The author discusses the various definitions of civil disobedience (Smart's definition, Eriksson's way of argumentation) and different ways of interpretati on.

ABSTRACT: Kirjoittaja esittelee Brian Smartin (1978) teorian kelvollisena määritelmänä kansalaistottelemattomuudesta.Smartin mukaan kansalaistottelemattomuus on ymmärrettävä tyypillisesti kommunikatiivisena tekona, joka on tarkoituksellinen, julkinen, laiton ja symbolinen.Sen avulla voidaan kansalaistottele- mattomuus erottaa tavallisista rikoksista sekä esim. terrorismista.Kirj. haluaa artikelillaan osoittaa, että joissakin tapauksissa tietyissä oloissa ja tietyin ehdoin, kansalaistottelemattomuus voi myös muun ohessa sisältää väki- valtaa ja olla silti oikeutettuna. The author presents Brian Smart's theory (1987) as a plausible definition of civil disobedience.According to Smart, civil disobedience should be seen as a typical action of communication; it has a purpose, it is public and, furthermore, it is symbolic.The definition can be used when distinguishing civil disobedience from ordinary crimes and e.g. terrorism.The author wants to demonstrate that in some cases, under certain circumstances and on certain conditions, civil disobedience may be violent and still justifiable.

The article criticizes Lars D.Eriksson's opinions on civil disobedience, Eriksson has characterized civil disobedience by saying that it is public, non-violent, international and criminal.The author presents, according to himself, a proper characterization of civil disobedience.The author shares Smart's view on civil disobedience.
